1. Introduction

Welcome to Ikytask ("the App"). These Terms and Conditions ("Terms") govern your use of the Ikytask mobile application and related services provided by Ivan Tsokol ("we," "us," or "our").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

2. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are under 13, you may not use the App under any circumstances.

3. Account Registration

To access certain features of the App, you must create an account using one of the following methods:

Email and password
Sign in with Apple
Sign in with Google

When using social login (Apple or Google), we collect your email address and name from your social account. You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized use of your account
Ensuring your social account credentials remain secure

You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

4. License to Use the App

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal mobile device solely for your personal, non-commercial use.

You may not:

Copy, modify, or create derivative works of the App
Reverse engineer, decompile, or disassemble the App
Rent, lease, loan, sell, or distribute the App
Remove or alter any copyright, trademark, or proprietary notices
Use the App for any illegal or unauthorized purpose

5. Premium Subscription

5.1 Free Version

The basic version of the App is available free of charge with limitations on the number of tasks you can create.

5.2 Premium Subscription

The Premium subscription removes task limitations and provides unlimited task creation. Premium subscription details:

Subscription fees are charged through your Apple App Store account
Subscriptions are tied to your Apple ID, not your Ikytask account
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
You can manage or cancel your subscription in your App Store account settings
No refunds are provided for partial subscription periods
Premium features are available only while the subscription is active

5.3 Subscription Independence

Important: Your Premium subscription is managed entirely by Apple and is linked to your Apple ID:

Deleting your Ikytask account does NOT cancel your subscription
Apple will continue billing you until you manually cancel through App Store settings
Creating a new Ikytask account does not restore subscription benefits from a deleted account
Each account requires its own separate subscription

5.4 Price Changes

We reserve the right to modify subscription prices. Price changes will be communicated in advance, and continued use after the price change constitutes acceptance of the new price.

6. Task Management and Virtual Buddy

The App provides task management features and a virtual buddy feature that celebrates completed tasks. All tasks and data you create remain your property, but you grant us a license to store and process this data to provide the App's functionality.

7. Data Synchronization

Your tasks and app data are synchronized across your devices through cloud storage. This synchronization requires an internet connection and is subject to our Privacy Policy.

8. Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the exclusive property of Ivan Tsokol or its licensors and are protected by international copyright, trademark, and other intellectual property laws.

The Ikytask name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Ivan Tsokol. You may not use such marks without our prior written permission.

9. User Conduct

You agree not to:

Use the App in any way that violates applicable laws or regulations
Attempt to gain unauthorized access to the App or its related systems
Interfere with or disrupt the App's operation or servers
Use any automated system to access the App
Impersonate any person or entity
Engage in any activity that could harm us or third parties

10. Termination

We reserve the right to suspend or terminate your account and access to the App at any time, with or without notice, for conduct that we believe:

Violates these Terms
Is harmful to other users, us, or third parties
Violates applicable laws or regulations

Upon termination, your right to use the App will immediately cease. We are not liable for any loss or damage arising from account termination.

You may terminate your account at any time by deleting it through the App settings (Other > Delete Account).

Critical Notice Regarding Subscriptions: Your Premium subscription is managed by Apple through your Apple ID, completely independent from your Ikytask account. Deleting your Ikytask account does NOT cancel your subscription. Apple will continue charging you until you manually cancel the subscription through your App Store account settings. To avoid unwanted charges, we strongly recommend cancelling your subscription before deleting your account.

11. Service Availability

We strive to provide a reliable and high-quality experience with the App. However, as with any software application:

The App's availability may occasionally be affected by maintenance, updates, or technical issues
Internet connectivity is required for synchronization features
We continuously work to fix bugs and improve performance through regular updates
The App's performance may vary depending on your device and operating system version

While we make every effort to ensure the App functions as intended, we cannot guarantee uninterrupted or error-free operation in all circumstances.

12. Indemnification

You agree to indemnify, defend, and hold harmless Ivan Tsokol from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of:

Your use of the App
Your violation of these Terms
Your violation of any rights of another party
Your violation of applicable laws or regulations

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

Posting the updated Terms in the App
Updating the "Last Updated" date
Sending notice to your registered email address (for significant changes)

Your continued use of the App after changes take effect constitutes acceptance of the modified Terms.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the European Union, particularly the General Data Protection Regulation (GDPR), without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the App shall be resolved through:

Good faith negotiations between the parties
If negotiations fail, binding arbitration in accordance with EU arbitration rules
Either party may seek injunctive relief in courts of competent jurisdiction

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ivan Tsokol regarding the App and supersede all prior agreements and understandings.

17. No Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

18. Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction.

19. Third-Party Services

The App integrates with third-party services including:

Apple Sign-In: For authentication via your Apple ID
Google Sign-In: For authentication via your Google account
Apple App Store: For subscription payments and app distribution
Supabase: For cloud storage and data synchronization
Expo: For app updates and push notifications
Push Notification Services: For sending task reminders and notifications (requires device token)

Your use of such services is subject to their respective terms and conditions and privacy policies. We are not responsible for third-party services or their data practices.

21. Language

These Terms are provided in English. In case of any conflict between the English version and any translation, the English version shall prevail.

By using Ikytask, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
